All employees have rights under the Ontario Employment Standards Act. As an employee there are certain basic responsibilities. For example, you are required to show up to work on time, work the required hours, and perform your job functions to the best of your ability. Similarly, employers have a responsibility to provide a safe environment, disburse wages on a timely basis, pay overtime pay when required to do so, and on termination, to provide the employee with a record of employment, termination pay, and severance pay where applicable. 


Employers have an obligation to provide an environment that is free from discrimination and harassment.  Any employee who feels that the practices and policies of their workplace is in contravention to the Human Rights Code may contact us at Central Legal Services so the appropriate application can be made.

What are my legal rights as an employee?

You have the right to be in an environment that is free from harassment. Your employer cannot use tactics like reducing your hours, changing your position, reducing your pay, placing you into subservient departments, or utilize any other tactics that could be viewed as a constructive dismissal.​

How much can I claim? 

Your claim has to be commensurate with the damages, embarrassment, or intolerance suffered by you.

The amount of your claim will vary depending on the severity and length of the suffering. Was the employer aware of your complaints? Were reasonable measures taken to address your concerns? These factors will be taken into consideration as we prepare your claim.

What will happen to my job if I file an application? 

Your employer’s obligated not to make any changes to your position, pay, or benefits package during the course of your application or at any time thereafter.
