What is the Highway Traffic Act?

The Highway Traffic Act is the governing act for motorists that use the road and highways of the province of Ontario. Violations of this act may result in your being required to attend before a Justice of the Peace to answer for these violations. Driving is a privilege, not a right. When you breach that privilege it may affect your ability to drive.

Are traffic offence lawyers worth it?

While each case is different, there are many reasons why obtaining legal representation is worth your while when faced with a traffic offence charge. Driving is a privilege, and that privilege may be suspended if you do not address the charges against you. 

 

The obvious consequences of being given an offence notice under the Highway Traffic Act are the demerit points that can be administered by the Ministry of Transportation and the potential for an increased insurance premium for many years to come.

 

Once an individual has obtained six, seven, or eight points, they are in the caution zone. Should the number of points continue to accumulate to nine assessed points, you may be called into the ministry to answer to the number of driving infractions leading up to this accumulation. At 15 points, your driver's licence will be suspended and your insurance company may adjust your premiums accordingly. In some instances, your insurance may be cancelled and you will have to seek out insurance from a facility carrier at an exponentially increased rate. It is important to get the proper representation to protect your privilege to drive. In many cases, people drive for a living and the consequences of failing to get adequate representation could be devastating.
